If requested, this contract is conditional upon said well permit approval. The well permit will be issued in the name of the Seller and Seller agrees to transfer said well permit to Buyer at Closing. Buyer will pay the application fee for said well application. If said well permit is not approved according to these terms, this Contract shall be voidable by either Seller or Buyer and Buyer`s earnest money deposit will be returned to the Buyer.
